EU Law: Intellectual Property Regimes in Europe

This course will familiarize students with the different areas of intellectual property rules in the European Union. While in some fields proprietors (including US corporations) may acquire EU titles (such as trade marks, design and plant variety rights), other titles are governed by peculiar combinations of EU and state law, called "harmonized" law (such as copyrights, databases and geographical denominations). The course will also present the specific features of the European (Munich) patent system. Students will be instructed to identify the body of law and jurisprudence relevant for a given intellectual property claim and to advice a potential client on strategies to obtain protection and to litigate in EU and/or state courts.
